This guidance is for businesses trading in parallel goods in the European Economic Area (EEA) and owners of intellectual property rights.<\/p>\n
Parallel trade is the import and export of genuine intellectual property (IP) protected goods. Parallel trade occurs when the intellectual property rights in those goods are \u2018exhausted\u2019. That is, they have been placed on the market within a specific territory by, or with the permission of, the rights holder. The exhaustion of\u00a0IP\u00a0rights means that\u00a0IP\u00a0rights cannot be used to stop the further distribution or resale of those goods.<\/p>\n
Parallel exports from the UK to the\u00a0EEA<\/strong><\/p>\n Goods placed on the UK market by, or with the consent of, the right holder may no longer be considered exhausted in the\u00a0EEA.<\/p>\n This means that businesses exporting these\u00a0IP-protected goods from the UK to the\u00a0EEA\u00a0might need the right holder\u2019s consent.<\/p>\n Actions for parallel exporters of\u00a0IP-protected goods to the\u00a0EEA<\/strong><\/p>\n Check whether you export\u00a0IP-protected goods to the\u00a0EEA\u00a0(for example, goods branded with a trade mark) that have already been placed on the UK market.<\/p>\n You may need to contact the rights holder to get permission to export those goods. The\u00a0IP\u00a0rights holder may not provide permission for their\u00a0IP-protected goods to be parallel exported to the\u00a0EEA.<\/p>\n You may need to review your business arrangements, business model or supply chain based on the outcome of the discussion with the\u00a0IP\u00a0rights holder.<\/p>\n Actions for\u00a0IP\u00a0rights holders<\/strong><\/p>\n Businesses that own\u00a0IP\u00a0rights (for example, a trade mark) may wish to seek legal advice if their\u00a0IP-protected goods are parallel exported from the UK to the\u00a0EEA. You will need to consider if you want to allow parallel exports of your\u00a0IP-protected goods from the UK to the\u00a0EEA.<\/p>\n Parallel imports from the\u00a0EEA\u00a0to the UK<\/strong><\/p>\n The\u00a0IP\u00a0rights in goods placed on the\u00a0EEA\u00a0market by, or with the consent of the right holder continue to be considered exhausted in the UK. This means that parallel imports into the UK from the\u00a0EEA\u00a0are unaffected.<\/p>\n Next steps<\/strong><\/p>\n The government plans to publish a formal consultation in early 2021 on what the UK should do about exhaustion and parallel trade in the future.
